राजभाषा अधिनियम का उल्लंघन

महोदय,
श्री   एम एल शर्मा सूचना आयुक्त केन्द्रीय सूचना आयोग  नई  दिल्ली , द्वारा राजभाषा अधिनियम का उल्लंघन 
                  उक्त प्रसंग में निवेदन है कि मैंने राजभाषा अधिनयम की भावना के अनुरूप विश्विद्यालय अनुदान आयोग से अपेक्षा की थी की वेबसाइट की सम्पूर्ण सूचना सामग्री का हिंदी अनुवाद जारी किया जाए और इसकी अनुपालना नहीं करने पर केन्द्रीय सूचना आयोग से इस आशय के आदेश हेतु निवेदन किया था| 4. यह है कि माननीय राष्ट्रपतिजी के आदेश को प्रसारित करते हुए राजभाषा विभाग के (राजपत्र में प्रकाशित) पत्रांक I/20012/07/2005-रा.भा.(नीति-1) दिनांक 02.07.2008 में संसदीय राजभाषा समिति की संस्तुति संख्या 44 में कहा गया है, “जब भी कोई मंत्रालय/विभाग या उसका कोई कार्यालय या उपक्रम अपनी वेबसाइट तैयार करे तो वह अनिवार्य रूप से द्विभाषी तैयार किया जाए| जिस कार्यालय का वेबसाइट केवल अंग्रेजी में है उसे द्विभाषी बनाए जाने की कार्यवाही की जाए|”  

 राष्ट्रीय सूचना विज्ञान केंद्र द्वारा जनवरी 2009 में जारी भारत सरकार की वेबसाइटों के लिए दिशा निर्देशके अध्याय 5 पैरा 5.7 के अनुसार “At present, majority of  the content in Government websites is in English, except few which have content in  Hindi or one of the Regional Languages. Thus though Government websites are accessible, they are still not usable. Hence, there is a need to put the information in Regional Languages.” गत जनगणना समंकों के अनुसार देश में हिंदी भाषी लोग 43% हैं जबकि अंग्रेजी भाषी लोग मात्र 0.021% हैं अतेव सूचना तक आम नागरिक की वास्तविक पहुँच व  पारदर्शिता के लिए धारा 4(4) के अनुसरण में इन्टरनेट पर हिंदी भाषा में प्रसारण समीचीन है| यहाँ यह निवेदन करना भी प्रासंगिक होगा कि भारत में इन्टरनेट पर उपलब्ध अधिकाँश जानकारी स्थानीय अथवा हिंदी भाषा में नहीं होने के कारण इन्टरनेट उपयोगकर्ताओं की संख्या मात्र 8% है वहीँ अमेरिका में यह 80 %  है| जनता द्वारा समझे जाने  योग्य भाषा में सूचना प्रदानगी के बिना अनुच्छेद  19 में गारंटीकृत जानने का अधिकारअर्थहीन है|

उत्तराखंड उच्च न्यायालय ने राज्य उपभोक्ता विवाद प्रतितोष आयोग के मामले में निर्णय (27.03.2010) में कहा है,  “An information must be given to a citizen in the language, which he understands. It is the legislative mandate that “information” must be disseminated considering, inter alia, the “local language” of the area. Similar is the mandate of the Constitution of India which is given under Article 350 read with Article 345 of the Constitution of India.”

किन्तु उक्त अधिकारी ने, संघ सरकार की सेवा में होते हुए, प्रकरण संख्या CIC/RM/A/2012/000217/LS में दिनांक 31.05.2013 को राजभाषा अधिनयम की भावना के  विपरीत निर्णय  देते हुए अपने निर्णय में कहा है , He may also consider putting some of this material in Hindi on UGC website (not the entire material).   अत: आपसे निवेदन है कि उक्त अधिकारी को समुचित निर्देश जारी करें|

Facts :-
Heard today dated 31.05.2013. Appellant not present. The UGC is represented by

2. It is noticed that in the RTI application dated 5.1.2012, the appellant had raised an
important issue regarding implementation of section 4(1)(b) of the RTI Act. As per this
provision, every Public Authority is mandated to publish the following information either in
manual form or in electronic form :-

“(i) the particulars of its organisation, functions and duties;
(ii) the powers and duties of its officers and employees;
(iii) the procedure followed in the decision making process, including channels of
supervision and accountability;
(iv) the norms set by it for the discharge of its functions;
(v) the rules, regulations, instructions, manuals and records, held by it or under its
control or used by its employees for discharging its functions;
(vi) a statement of the categories of documents that are held by it or under its control;
(vii) the particulars of any arrangement that exists for consultation with, or
representation by, the members of the public in relation to the formulation of its policy or implementation thereof;
(viii) a statement of the boards, councils, committees and other bodies consisting of
two or more persons constituted as its part or for the purpose of its advice, and as to whether meetings of those boards, councils, committees and other bodies are open to the public, or the minutes of such meetings are accessible for public;
(ix) a directory of its officers and employees;
(x) the monthly remuneration received by each of its officers and employees, including the system of compensation as provided in its regulations;
(xi) the budget allocated to each of its agency, indicating the particulars of all plans, proposed expenditures and reports on disbursements made;
(xii) the manner of execution of subsidy programmes, including the amounts allocated and the details of beneficiaries of such programmes;
(xiii) particulars of recipients of concessions, permits or authorisations granted by it;
(xiv) details in respect of the information, available to or held by it, reduced in an
electronic form;
(xv) the particulars of facilities available to citizens for obtaining information, including the working hours of a library or reading room, if maintained for public use;
(xvi) the names, designations and other particulars of the Public Information Officers;
(xvii) such other information as may be prescribed and thereafter update these publications every year;”


3. I am informed that voluntary disclosure on some of the topics has already been made
but it is my impression that a lot more needs to be done. In view of the above, Dr. Akhilesh
Gupta, Secretary, UGC, is hereby desired to look into the matter personally and have the
provisions of section 4(1)(b) implemented to the extent practicable in next 03 months time.
He may also consider putting some of this material in Hindi on UGC website (not the entire
material) for the benefit of Hindi speaking people.

4. The matter is being disposed of accordingly.

 I am in complete agreement with Sshriharsha Sharma. I have been writing letters to almost all Hindi news channel about excessive use of Urdu and of those words which are unwanted/unwarranted. I had given them examples of the words used on news channel in Urdu and their Hindi synonyms words. I see a huge conspiracy in polluting our Hindi. To give a few examples of the words often used on news channel are as under;

Saksh =  Vyakti  (person)
Tafdeesh = Chaanbeen (investigation)
Salaam = Pranam
Shukriya = Dhanyawad
Dua = Ashirwad

These are only few examples of the Urdu words most often used on our Hindi news channel. There has been no improvement and in the past six months or so a new trend is seen emerging that of using English words. Nesreaders/reporters who can neither speak English or Hindi are using Hinglish as the mode of communication and I see a grave danger in destroying our great language. 200 languages have been decimated in the past 20 yrs and Hindi will remain in the text books if we all don't rise to the occasion like China.  

China banned by a legislation use of Chinglish which is mixture of Chinese and English languages as Hinglish is mixture of Hindi and English. We have to everyting possible to save our national language which print and electronic media is out to destroy completely. You will be shocked to note that there are many Hindi newspapers in North India who have become 80% Hinglish. The words printed are in Hindi but written in English such as salary instead of Vetan etc. !

This is well known that Urdu played a significant role to motivate,  incite, excite for the division /partition and in braking up of India  in 1947.

Kindly do your own research  on this because I read many articles when  I was in college during 1971 war with Pakistan Which led to the  formation of Bangladesh.

East Pakistan could not tolerate Urdu being imposed on Bengali  Muslims and in this context the articles appeared and urdu was  also  responsible for the problem to greater or lesser extent.  Urdu  was  divisive for  united Hindusthan and even now Urdu news papers support terrorists and Pakistan which is against India but  Government of India due to policy of appeasement of Muslims does not  take any strong action which is unfortunate.

  I do not think you are acting wisely in advocating in favour of Urdu.

  I have read your article no. 1. but I am not convinced .   A WISE MAN NEVER PUTS HIS HAND TWUCE IN A SNAKE HOLE.

Urduwalas do not accept your argument and  so do not waste your breath  to convince  Urduwalas they would put dagger in the heart of Hindi.  Learn lessons from the past mistakes [own and peers].  I hope you would act in promotion, progress and development of Hindi and pure Hindi that will be the best service to Hindi.

Great  work is needed to have an encyclopaedia of Hindi  .

This refers to the ICCR's advertisement, " Jashn-e-Azaadi" published in The Telegraph of 13.08.2013.

  The text of this advertisement reads," Rabindranath Tagore Centre, ICCR, Kolkata presents in its Horizon Series, JASHN-E-AZAADI a musical tribute to India through a Hindustani Classical Vocal Recital by Kumar Mukherjee and his disciples on 16th August at the Satyajit Ray Auditorium, RTC, ICCR.

I take strong exception to this title which could have been " Swadinata Utsav". This glaringly shows UPA government's preference for Urdu and negligence of Hindi/Bengali.

348. (1) Notwithstanding anything in the foregoing

Official language for communication between one State and another or between a State and the Union. Language to be used in the Supreme Court and in the High Courts and for Acts, Bills, etc.

(b) the authoritative texts—
(i) of all Bills to be introduced or amendments thereto to be moved in either House of Parliament or in the House or either House of the Legislature of a State,
(ii) of all Acts passed by Parliament or the Legislature of a State and of all Ordinances promulgated by the President or the Governor 1*** of a State, and
(iii) of all orders, rules, regulations and bye-laws issued under this Constitution or under any law made by Parliament or the Legislature of a State, shall be in the English language.

Many media people are trying to make proper Hindi words vanish or LUPT. Proper Hindi words are available still Hindi media people prefer to use Urdu or English words in Hindi. Some Examples are:

There are several thousand Urdu words which are used in Hindi. Sad thing is that many saints and priests who are supposed to know proper Hindi use such Urdu words along with English words in Hindi. People who know proper Hindi should Telephone or send message by any means to media people that they should use proper Hindi words in Hindi.
